Max Telecom: Terms of Max Telecom Ltd. for remote services contracts

I. GENERAL CONDITIONS

1. With these conditions, under Section II, Art. 48-61 of the Law on Protection of Consumer Rights, are determined the procedure, terms and conditions of a contract to provide remote services between "Max Telecom" Ltd, hereinafter referred to as "Max Telecom", with headquarters and address - Sofia, "Metodi Popov" str. 24, having the right to provide Internet and voice services on the base of the individual license for carrying out telecommunications through a public telecommunications network of the fixed radio service of type "point to many points" and subscribers and users of the public electronic communications network of "Max Telecom" in connection with the provision and use of services of this network in Bulgaria.

2. These Terms apply to all cases where a contract between "Max Telecom" and physical and/or entity (subscriber) is concluded for a remote services (a contract based on a proposal from "Max Telecom", where from the date the proposal was made until the conclusion of the contract the parties are not in physical contact with each other).

II. PROCEDURE FOR CONCLUSION OF A REMOTE CONTRACT 

1. To submit a proposal "Max Telecom" for Remote Service/s the following communication devices will be used: 

1.1. addressed and unaddressed printed materials of "Max Telecom";
1.2. letter to the consumer;
1.3. radio;
1.4. TV;
1.5. videotext;
1.6. e-mail;
1.7. Internet;
1.8. fax;
1.9. phone;
1.10. others permitted by law.

2. Anyone wishing to sign a contract for remote service/s may make a request on the following "Max Telecom" numbers: 0999 111 and 0700 11199. Requests may also be sent online on the following email address: shop.maxtelecom.bg by following the instructions listed on that address.

3. The one offering the proposal by phone, respectively the representative of "Max Telecom" receiving a telephone request is obliged to inform the users of his identity and to reveal the commercial purpose of the offer at the beginning of each call.

4. The proposal of "Max Telecom" to customers selling remote service/s should contain the following information:

4.1. The name and the address of "Max Telecom";
4.2. The main features of the service - name of the selected package, Internet access speed, how many free minutes are available, terms and conditions of the contract, additional services (MaxTV, MaxOffice etc.);
4.3. The type of device to connect to the network, the way it will be provided and the type of installation of that service;
4.4. The price of the Services including value added tax per month;
4.5. The payment method of that Service, the delivery and the performance of the contract;
4.6. Consumer's right to cancel the contract and the conditions under which the provided by "Max Telecom" device can be returned;
4.7. The period for which the offer or the price are valid, including the duration of the promotion /if the user wants to take advantage of a special promotional offer of "Max Telecom"/;
4.8. The minimum time period the contracts for that service will be valid;
4.9. Eventually any penalties envisaged for early termination of contract.

5. The information under the above item 4 will be provided to users in a clear and understandable way, depending on the type of the communication device used and will emphasize the commercial nature of the proposal in accordance with the principle of good faith in commercial transactions and good commercial practice .

III. RIGHTS AND OBLIGATIONS of "Max Telecom"

1. "Max Telecom" shall, within 7/seven days of receiving the request /by phone or email/ send a written confirmation to the consumer, containing the following information:

1.1. The name of "Max Telecom" and the address to which consumers can send complaints.

1.2.  Consumer's right to withdraw the contract, the terms and conditions and the manner this right is exercised as well as the return of the equipment;

1.3. The main characteristics of the requested service and conditions of the contract between the "Max Telecom" and the respective subscriber for this Service;

1.4. The conditions for termination, respectively the penalties due to early termination of contract;

1.5. The way the contract is being sent and the device to connect to the network;

1.6. The details of the provided service after the sale.

2. When contracts for remote services are concluded "Max Telecom" will provide the user via courier a package containing two copies of the contract, subject to conclusion from distance, signed by the company and a Device to connect to the network. Upon receipt of the package, the user is obliged to identify himself to the courier with his ID, and then to sign the contract and the delivery slip and give a copy of the contract and slip back to the courier.

IV. RIGHTS AND OBLIGATIONS OF THE SUBSCRIBER

1. The subscriber has the right, without compensation or penalty are due, and without giving any reason, to withdraw the concluded remote contract and to return the device within 7 working days from the date of the contract by calling the above phone or by sending an e-mail to the above email address. In the call, respectively the e-mail, a representative of "Max Telecom" explains in detail to the customer how to cancel the contract and how to return the device.

2. If the subscriber withdraws the remote contract he should return the device to connect to the network within the period pointed out in item 1 above, in its original packaging and with no damages, at the place and the manner specified by the representative of the "Max Telecom" under Item 1, above.

V. Conditions upon which the contract for remote service enters into force

1. The contract between the subscriber and "Max Telecom" enters into force from the date the subscriber has signed the receipt for the delivery of the service.

2. "Max Telecom" provides the Service/s within the terms and conditions provided in the General Conditions for Internet and/or voice services provision.

VI. Final Conditions

1. For all outstanding issues in these Terms, the relevant provisions of the Bulgarian legislation are executed.

2. When disputes arise, the parties settle them by negotiation in a spirit of mutual understanding and if they fail to agree they have to refer the dispute to the competent Bulgarian court.

These Terms are an integral part of the General Conditions of "Max Telecom" for Internet and voice services, published on the company website www.maxtelecom.bg and have effect to all subscribers and users of the services concerned and the ones interested in a conclusion of remote service contracts.
